Pre-publication in the Canada Gazette Part I

  • Minor Works and Waters (NWPA) Regulations
  • Regulations Amending Certain Regulations Made Under the Canada Shipping Act, 2001 (Miscellaneous Amendments Regulation) (CSA 2001)
  • Regulations Amending the Collision Regulations (Miscellaneous Amendments Regulation) (CSA 2001)
  • Vessel Pollution and Dangerous Chemicals Regulations (Phase 1) (CSA 2001)

Final approval and publication in the Canada Gazette, Part II

  • Ballast Water Control and Management Regulations (Phase 1) (CSA 2001)

Administrative Monetary Penalties Regulations

  • Currently only designates the statutory provisions of the CSA 2001 as violations.
  • Administrative Monetary Penalties Regulations will be amended to also designate provisions of certain CSA 2001 regulations as violations.
  • Stakeholders were asked to identify those provisions that they recommended for inclusion in the CSA 2001 AMP Regime, as well as propose a penalty range for each.
  • Anticipated for pre-publication in Part I of the Canada Gazette this fall/winter 2011.

Ballast Water Control and Management Regulations

  • Will repeal and replace the existing Ballast Water Control and Management Regulations using a two-phased approach.
  • Phase 1 – Amend the current regulatory text to be in line with the text of the CSA 2001. Proposed Regulations pre-published in Part I of the Canada Gazette on December 18, 2010. Anticipated for final approval and publication in Part II of the Canada Gazette fall/winter 2011.
  • Phase 2 – Will bring in provisions of the Convention for the Control and Management of Ships’ Ballast Water and Sediments. Anticipated for pre-publication in Part I of the Canada Gazette in early 2012.

Minor Works and Waters (NWPA) Regulations

  • Part 7 of Bill C-10 amended the NWPA on March 12, 2009.
  • The Minor Works and Waters (Navigable Waters Protection Act) Order was made on April 22, 2009 and came into force on June 7, 2009.
  • The intent of the changes to the NWPA, the Ministerial Order and the proposed Regulations are numerous.
  • Draft Regulations are now posted on the CMAC and NWPA Web sites for comment.
  • Proposed Regulations are anticipated for pre-publication in Part I of the Canada Gazette in the spring 2012.

Vessel Fire Safety Regulations

  • The proposed Vessel Fire Safety Regulations will repeal and replace the existing Fire Safety Regulations.
  • The proposed Regulations are anticipated for pre-publication in Part I of the Canada Gazette in the fall/winter 2011.

Vessel Pollution and Dangerous Chemicals Regulations

  • Will repeal and replace the existing Regulations for the Prevention of Pollution from Ships and for Dangerous Chemicals using a two-phased approach.
  • Phase 1 – Amend the current regulatory text to be in line with the text of the CSA 2001. Anticipated for pre-publication in Part I of the Canada Gazette this fall/winter 2011.
  • Phase 2 – Major changes relating to air emissions, grey water, and barges.
